Introduction
These Terms and Conditions govern the relationship between Tray Tables Up (“Tray Tables Up,” “we,” “us,” or “our”) and you, the client or traveler (“Client,” “you,” or “your”). By engaging Tray Tables Up’s travel advisory services, booking travel through us, or using our website, you agree to be bound by these Terms and Conditions.
Tray Tables Up acts solely as a booking agent and travel advisor for disclosed principal suppliers including tour operators, cruise lines, hotels, airlines, ground transportation providers, and other independent contractors providing accommodations, transportation, and services (“Suppliers”). We are not the source or provider of travel services. These Terms include warranties, disclaimers, and limitations of liability that may restrict your rights and remedies.
1. Use of Services and Client Obligations
1.1 Legal Authority
You warrant that you are at least 18 years of age and possess the legal authority to enter into this agreement and make travel bookings. You agree to be financially responsible for all travel bookings made through us, whether for yourself or other members of your traveling party.
1.2 Accuracy of Information
You warrant that all information provided by you on behalf of yourself, members of your household, or others you are authorized to represent is true, accurate, and complete. This includes but is not limited to names (as they appear on passports), dates of birth, contact information, and any special requirements or restrictions.
1.3 Legitimate Reservations
You agree to make only legitimate reservations or purchases. Speculative, false, or fraudulent reservations are strictly prohibited.
1.4 Supplier Terms
By booking travel through Tray Tables Up, you agree to abide by the terms and conditions of each Supplier whose services appear in your itinerary. Separate Supplier terms will apply to your reservation and purchase of travel-related goods and services.
2. Independent Arrangements
Tray Tables Up is not liable or responsible for any travel arrangements made independently of our services. We assume no responsibility for costs or fees you incur for independent arrangements not booked through us, including but not limited to:
- Airline tickets purchased separately
- Hotel reservations made independently
- Excursions or activities booked directly
- Travel insurance purchased elsewhere
If you make your own flight arrangements, we are not responsible for any loss resulting from cancellation or changes in itineraries, travel dates, or connections. We cannot assist with schedule changes or delays related to air reservations made independently.
3. Professional Affiliations
Tray Tables Up operates as an independent travel advisor affiliated with Fora Travel. We are committed to providing personalized travel planning services while maintaining the highest standards of professionalism and client care.
4. Payments, Deposits, and Fees
4.1 Travel Advisory Fees
Tray Tables Up charges professional planning fees for our advisory services. These fees are separate from the cost of travel services and are non-refundable once work has commenced on your itinerary. Fee structures will be clearly communicated and agreed upon before services begin.
4.2 Payment Authorization
By submitting payment information or a credit card authorization form, you authorize Tray Tables Up to use your payment method to purchase travel products from Suppliers on your behalf.
4.3 Deposits and Final Payments
All payments for travel are due according to each Supplier’s terms and conditions of booking. Failure to make deposits or final payments by the required dates may result in:
- Cancellation of your reservations
- Denial of access to flights, tours, hotels, cruises, or other services
- Forfeiture of monies paid
4.4 No Chargebacks
EXCEPT IN CASES OF FRAUD, YOU AGREE NOT TO FILE A DISPUTE WITH YOUR BANK OR CREDIT CARD COMPANY TO AVOID OR VIOLATE ANY BOOKING TERMS AND CONDITIONS. If you attempt to chargeback, reverse, or recollect a previously authorized trip payment, Tray Tables Up reserves the right to collect all additional costs, fees, and expenses associated with such chargeback, including attorney fees.
5. Cancellations, Changes, and Refunds
5.1 Cancellation Requests
All cancellation requests must be submitted to Tray Tables Up in writing via email. Verbal cancellation requests will not be processed.
5.2 Cancellation Penalties
As a result of cancellation or changes to confirmed bookings, both Tray Tables Up’s fees and third-party Supplier cancellation penalties will apply. In some cases, there is NO REFUND once a booking is made and under deposit. Cancellation fees will be charged to your authorized payment method or deducted from any Supplier refund.
5.3 Changes to Bookings
If you decide to change any portion of your confirmed arrangements, we will attempt to assist you. However:
- Certain bookings may not be changeable
- You will be responsible for any increases in cost imposed by the Supplier
- Change fees from both Tray Tables Up and Suppliers may apply
- All change requests must be made in writing
5.4 Unused Services
When tour, cruise, or package prices are based on Suppliers’ contract rates, you will not be entitled to any refund for unused portions of travel.
6. Travel Documents and Identification
6.1 Client Responsibility
It is your sole responsibility to obtain and carry valid travel documents including:
- Passport (book, not card for international travel)
- Visas
- Entry permits
- Health certificates
- Any other documents required by applicable government regulations
6.2 Passport Validity
Many countries require that your passport be valid for at least six months beyond your anticipated return date. Non-United States citizens may require additional documentation.
6.3 Name Accuracy
THE NAME, DATE OF BIRTH, AND GENDER ON YOUR IDENTIFICATION MUST EXACTLY MATCH THE INFORMATION ON YOUR TICKETS AND BOOKING RECORDS. Any discrepancy may result in denied boarding or delays causing you to miss flights and subsequent scheduled travel.
6.4 Document Review
WHEN YOU RECEIVE YOUR TRAVEL DOCUMENTS, REVIEW ALL INFORMATION IMMEDIATELY FOR ACCURACY. Contact Tray Tables Up within 24 hours if changes or corrections are required. If you have not notified us of necessary corrections within 24 hours of receiving your documents, Tray Tables Up bears no responsibility for any additional costs associated with making corrections.
6.5 Minors Traveling
Children and infants require travel documents. Minors traveling with one parent or without both parents may require authenticated consent forms. Please consult U.S. Customs and Border Protection for specific requirements.
7. Entry Requirements and Criminal Records
7.1 Individual Requirements
Each country maintains different entry and exit requirements. If you have a current or prior criminal offense, contact the destination country directly for entry requirements. We do not inquire about criminal records in the interest of client privacy.
7.2 State Department Resources
Visit the U.S. State Department website (https://travel.state.gov) for information about specific destination requirements.
8. Health, Immunizations, and Safety
8.1 Immunization Requirements
You must obtain proper immunizations, health screenings, and required documentation before travel. Tray Tables Up does not assume responsibility for the accuracy of health, vaccination, or documentation requirements.
8.2 Health Resources
Check the Centers for Disease Control (https://wwwnc.cdc.gov/travel/) for health issues related to travel and the State Department website for current travel advisories.
8.3 Pre-Existing Conditions
By booking travel with us, you acknowledge that certain activities may activate or aggravate pre-existing injuries or conditions. You should seek medical advice if you know or suspect your physical condition may be incompatible with planned activities.
8.4 Assumption of Risk
BY OFFERING TRAVEL TO PARTICULAR DESTINATIONS, TRAY TABLES UP DOES NOT REPRESENT OR WARRANT THAT TRAVEL TO SUCH DESTINATIONS IS ADVISABLE OR WITHOUT RISK. We shall not be liable for costs, damages, or losses that may result from travel to such destinations. Your participation constitutes acceptance of such risks.
8.5 Smart Traveler Enrollment Program (STEP)
We recommend enrolling in STEP (https://step.state.gov), a free service for U.S. citizens traveling abroad that allows the State Department to assist you in emergencies.
9. Air Travel
9.1 Airline Relationship
Your airline ticket is a contract between you and the air carrier. Tray Tables Up functions solely as a booking agent for the airline and does not control airline operations.
9.2 Airline Policies
We are not liable for:
- Personal injury or property damage related to air travel
- Acts, errors, or omissions by airlines
- Airline failure to deliver services
- Airline policies including refund or rebooking terms
- Fees for checked or carry-on luggage
- Fuel surcharges
- Airline bankruptcy or cessation of operations
9.3 Schedule Changes
We do not assume responsibility for airline schedule changes. Reconfirm flight times at least 24 hours prior to departure for domestic flights and 72 hours for international flights.
9.4 Check-In Requirements
It is strongly recommended that you check in a minimum of 2 hours prior to scheduled departure for domestic flights and 3 hours for international flights.
9.5 Frequent Flyer Programs
Mileage accrual and upgrades are at the discretion of airlines. Tray Tables Up has no liability if accrual of miles or points is denied or if upgrades are not allowed.
10. Travel Insurance
10.1 Highly Recommended
THE PURCHASE OF COMPREHENSIVE TRAVEL INSURANCE IS HIGHLY RECOMMENDED ON ALL TRIPS. Unless specifically noted, travel insurance is not included in the cost of your itinerary.
10.2 Coverage Types
Proper travel insurance may protect you from financial loss in circumstances including:
- Trip cancellation
- Trip interruption
- Travel delays
- Medical emergencies
- Emergency medical evacuation
- Baggage loss or delay
- Supplier bankruptcy or default
- COVID-19 related issues (subject to policy terms)
10.3 Insurance Disclaimer
Tray Tables Up is not a licensed insurance broker. Our advisors are not qualified to answer technical questions about benefits, exclusions, and conditions of insurance policies. We cannot guarantee that any insurance provider will approve coverage for a claim.
10.4 Client Responsibility
It is your responsibility to understand what your insurance policy covers and to put alternative coverage in place if needed. If you decline to purchase insurance, we may require that you sign an insurance waiver.
11. Limitations of Responsibility
11.1 Agent Status
Tray Tables Up acts solely as a booking agent for disclosed principal Suppliers and is not the source or provider of travel services. Each Supplier is an independent entity not subject to our control.
11.2 Dietary Restrictions
We are not responsible if a restaurant, tour operator, cruise line, or other service provider is unable to or fails to accommodate your dietary restrictions or requirements.
11.3 Itinerary Changes
Suppliers may determine that alterations to itineraries are necessary for reasons including severe weather, safety concerns, or operational issues. Such alterations are at the sole discretion of the Supplier, and Tray Tables Up bears no responsibility for changes.
11.4 Disclaimer of Liability
BECAUSE TRAY TABLES UP ACTS AS AGENT FOR DISCLOSED PRINCIPAL SUPPLIERS AND DOES NOT CONTROL THE OPERATIONS OF INDEPENDENT OPERATORS, WE ARE NOT LIABLE FOR ANY PERSONAL INJURY OR PROPERTY DAMAGE ARISING FROM THESE SERVICES. We hereby disclaim any liability, whether based on contract, tort, strict liability, or otherwise, including without limitation liability for any direct, punitive, special, consequential, incidental, or indirect damages in connection with goods or services provided by any Supplier.
11.5 Limitation of Recovery
TRAY TABLES UP RECEIVES COMMISSION AND FEES FOR TRAVEL TRANSACTIONS. ANY RECOVERY FROM TRAY TABLES UP WILL BE LIMITED TO THE AMOUNT OF COMMISSION AND FEES ACTUALLY RECEIVED BY US.
12. Force Majeure
Tray Tables Up will not be in breach of these Terms or liable to you for any failure or delay in performing obligations due to causes beyond our reasonable control, including:
- Acts of God
- Natural disasters (earthquakes, floods, volcanic eruptions, hurricanes, wildfires)
- Epidemics or pandemics
- Terrorist acts or war
- Civil unrest or riots
- Government actions or travel restrictions
- Strikes or labor disputes
- Breakdown of communication or technology systems
In the event of Force Majeure, Suppliers may vary, postpone, or cancel any itinerary or arrangement. Payment of refunds remains in the sole discretion of the Supplier, although we will use reasonable efforts to secure reimbursement where possible.
13. Client Conduct
13.1 Expected Behavior
Each participant is expected to act responsibly and adhere to behavior guidelines established by Tray Tables Up and our Suppliers, including dress codes at religious or cultural sites.
13.2 Removal from Travel
We and all Suppliers reserve the right to remove you from any facility, hotel, tour location, or means of transportation if your health or conduct:
- Endangers yourself or others
- Disrupts the well-being of other travelers
- Interferes with operations or security
In such cases, there will be no refund.
13.3 Liability for Damage
You accept responsibility for any damage or loss caused by you. Full payment must be made directly to the accommodation owner, manager, or other Supplier. You must indemnify Tray Tables Up for the full amount of any claim made against us.
13.4 Illegal Substances
Any transportation, possession, or use of illegal drugs will result in immediate termination of your trip and may result in prosecution. You are responsible for knowing and observing licensing laws for all countries and states you visit.
14. Errors and Availability
We reserve the right to correct errors. In the event of any pricing error or omission, we reserve the right to adjust pricing or make corrections. All offers, incentives, and promotions are subject to availability and may change without notice.
15. Governing Law and Disputes
15.1 Jurisdiction
These Terms and Conditions are governed by the laws of the State of Colorado. You consent to the exclusive jurisdiction and venue of courts in Denver County, Colorado for all disputes arising out of or relating to travel bookings.
15.2 Time Limit for Claims
Any claim against Tray Tables Up must be brought within 12 months after the date of completion of the trip and not later.
15.3 Limitation of Damages
Tray Tables Up shall not be liable for damages other than compensatory damages, and you waive any right to claim punitive or exemplary damages.
15.4 No Class Actions
You agree that you may only bring claims in your individual capacity and not as a plaintiff or class member in any class action, proposed class action, or representative action. You expressly waive all rights to bring such class actions or representative actions.
16. Amendments to Terms
We reserve the right to change these Terms and Conditions at any time in our sole discretion. Updated versions will be provided to clients and posted on our website, effective immediately upon posting.
17. Entire Agreement
These Terms and Conditions (and any other terms referenced herein) constitute the entire agreement between you and Tray Tables Up with respect to travel bookings and services. They supersede all prior or contemporaneous communications, whether electronic, oral, or written.
18. Severability
If any part of these Terms is determined to be invalid or unenforceable, the invalid provision will be deemed superseded by a valid provision that most closely matches the intent of the original, and the agreement shall continue in effect.
